Welcome to Sharjah Centre. The terms "we", "us", and "our" refer to Sharjah Centre. We operate this store and website, including all related information, content, features, tools, products, and services provided to you, the customer (the "Services"). Sharjah Centre is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service, together with any policies referenced within them (these "Terms"), describe your rights and responsibilities when you use the Services. Please read them carefully, as they include important information about your legal rights, including warranty disclaimers and limitations of liability.

1. Access and Account

You represent that you are at least 18 years old (the age of majority in Pakistan), or that you are using the Services under the supervision of a parent or legal guardian.

To use the Services — including browsing our store or purchasing products — you may be asked to provide information such as your name, email address, billing, payment, and shipping details. You represent that all information you provide is correct, current, and complete, and that you have the right to provide it.

You are solely responsible for maintaining the security of your account credentials and for all activity under your account. You may not transfer, sell, assign, or license your account to any other person.

2. Our Products

We sell home-living products including dinner sets, cookware, tea sets, cutlery, hotelware, décor, and kitchen electronics.

We make every effort to represent our products accurately. However, colours, finishes, and textures may differ from how they appear on your screen due to your device, its settings, and natural variation in materials such as ceramic, porcelain, and glass. Slight variations are not defects, and we do not warrant that any product will be identical to how it is depicted online.

All product descriptions are subject to change at any time without notice at our sole discretion. We reserve the right to discontinue any product and to limit the quantities of any product we offer to any person, region, or order.

3. Orders

When you place an order, you are making an offer to purchase. We reserve the right to accept or decline your order for any reason at our discretion. Your order is not accepted until we confirm acceptance, and we must receive and process your payment before an order is accepted. Please review your order carefully before submitting, as we may be unable to accommodate cancellations after an order is accepted.

If we do not accept, change, or cancel an order, we will attempt to notify you using the email, address, or phone number you provided. Where we cancel a paid order, we will issue a full refund.

Your purchases are subject to return or exchange solely in accordance with our Refund and Returns Policy [LINK]. You represent that your purchases are for your own personal or household use and not for commercial resale or export.

4. Prices and Billing

All prices are listed in Pakistani Rupees (PKR). The price charged will be the price in effect when your order is placed and will be set out in your order confirmation. Unless stated otherwise, posted prices do not include shipping, handling, or applicable taxes.

Prices, discounts, and promotions are subject to change without notice, and online prices may differ from those in our physical store. Promotions may be governed by separate terms, which will prevail in the event of a conflict.

You agree to provide current, complete, and accurate purchase and payment information, and to update it promptly so we can complete your transactions. Where you pay by card, you represent that the card information is true and correct, that you are authorised to use the card, and that you will pay all charges incurred, including shipping and applicable taxes.

5. Shipping and Delivery

Delivery timelines, charges, and coverage areas are set out in our Shipping Policy [LINK]. All delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by couriers or events outside our control. Once products are handed to the carrier, title and risk of loss pass to you.

6. Returns, Exchanges, and Refunds

Returns, exchanges, and refunds are governed by our Refund and Returns Policy [LINK], which forms part of these Terms.

7. Intellectual Property

Our Services — including all trademarks, brands, text, images, graphics, product photography, video, and audio, and their selection and arrangement — are owned by Sharjah Centre, its affiliates, or licensors, and are protected under applicable intellectual property laws.

These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, republish, download, store, or transmit any material from the Services without our prior written consent. Unauthorised use may violate applicable intellectual property laws. All rights not expressly granted are reserved.

The Sharjah Centre name, logo, and slogans are our trademarks and may not be used without our prior written permission. Shopify's name and logo are trademarks of Shopify. All other trademarks on the Services belong to their respective owners.

8. Optional Third-Party Tools

You may be given access to third-party tools through the Services which we neither monitor nor control. We provide access to such tools "as is" and "as available", without warranties or endorsement, and we have no liability arising from your use of them. Any use of these optional tools is entirely at your own risk, and you should review the relevant third party's terms. Any new tools or features we add in future are also subject to these Terms.

The Services may contain links to websites operated by third parties. We are not responsible for examining or evaluating their content or accuracy, and are not liable for any harm related to your use of them. 10. Relationship with Shopify

Sharjah Centre is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with Sharjah Centre. By using the Services, you acknowledge that Shopify is not responsible for any aspect of any sale between you and Sharjah Centre, including any injury, damage, or loss resulting from purchased products and services. You expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Sharjah Centre.

11. Privacy Policy

Because the Services are hosted by Shopify, certain personal information may also be subject to Shopify's Privacy Policy. You represent that you own or have all necessary rights to your Feedback, that it does not violate any third-party right (including copyright, trademark, or privacy) or any law, and that it contains no unlawful, abusive, or obscene material or malicious code. You may not impersonate any person or misrepresent the origin of any Feedback. We are under no obligation to keep Feedback confidential, to compensate you for it, or to respond to it, and we may remove any Feedback we consider objectionable at our sole discretion.

13. Errors, Inaccuracies, and Omissions

Occasionally there may be information in the Services containing typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, shipping charges, transit times, or availability. We reserve the right to correct any such errors and to change or update information or cancel orders if any information is inaccurate, at any time without prior notice, including after you have submitted your order.

You further agree not to: (a) upload viruses or malicious code; (b) reproduce, duplicate, resell, or exploit any portion of the Services; (c) collect or track the personal information of others; (d) phish or pretext the Services; (e) use any robot, spider, scraper, data-extraction tool, or automated means to access the Services; or (f) bypass or circumvent any security or access-control measures. We may suspend, disable, or terminate your account at any time, without notice, if we determine you have violated these Terms.

15. Automated Access and AI Agents

This section applies if you use, enable, or cause the deployment of an Agent to access or interact with the Services. An "Agent" means any software or service that takes autonomous or semi-autonomous action on behalf of, or at the instruction of, any person, without direct supervision.

No Agent may access or interact with the Services unless it identifies itself and operates in accordance with the requirements below, and no Agent may access the Services where we have requested it to refrain. We may limit, including by technical measures, whether and how any Agent accesses the Services.

Agents must: (i) identify in all HTTP/HTTPS requests that the request is from an Agent and disclose its name in the user-agent string (e.g. "Agent/[agent name]"); (ii) not conceal that access is from an Agent, mimic human behaviour, or circumvent CAPTCHAs or similar measures; (iii) respond truthfully to any prompt seeking to determine whether interactions come from a human or a computer; and (iv) not circumvent any measure intended to control how Agents access the Services.

We may terminate these Terms or your access to the Services at our sole discretion at any time without notice, and you will remain liable for all amounts due up to and including the date of termination. The following sections survive termination: Intellectual Property, Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver and Entire Agreement, Assignment, Governing Law, Privacy Policy, and any other provisions that by their nature should survive.

EXCEPT AS EXPRESSLY STATED BY SHARJAH CENTRE, THE SERVICES AND ALL PRODUCTS OFFERED THROUGH THEM ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY REPRESENTATION, WARRANTY, OR CONDITION OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. WHERE APPLICABLE LAW DOES NOT PERMIT THE EXCLUSION OF CERTAIN WARRANTIES, THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.

18. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO CASE SHALL SHARJAH CENTRE, ITS DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, OR SUPPLIERS BE LIABLE FOR ANY INJURY, LOSS, OR CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND — INCLUDING LOST PROFITS, LOST REVENUE, LOST DATA, OR REPLACEMENT COSTS — ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCT PURCHASED THROUGH THEM, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTHING IN THESE TERMS EXCLUDES LIABILITY THAT CANNOT BE EXCLUDED UNDER APPLICABLE LAW.

19. Indemnification

You agree to indemnify, defend, and hold harmless Sharjah Centre and its affiliates, officers, directors, employees, agents, and suppliers from any losses, damages, liabilities, or claims, including reasonable legal fees, arising out of (1) your breach of these Terms or any documents they incorporate, (2) your violation of any law or the rights of a third party, or (3) your access to and use of the Services.

We will notify you of any indemnifiable claim, and may control its defence and settlement at your expense, but will not settle any claim requiring non-monetary obligations from you without your consent (not to be unreasonably withheld). You agree to cooperate in the defence of any such claim.

20. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be enforceable to the fullest extent permitted by law, and the unenforceable portion shall be severed. Such a determination does not affect the validity of the remaining provisions.

21. Waiver and Entire Agreement

Our failure to exercise or enforce any right or provision of these Terms does not constitute a waiver of it. These Terms, together with any policies posted on our site, constitute the entire agreement between you and us regarding the Services and supersede any prior agreements. Any ambiguity in these Terms shall not be construed against us as the drafting party.

22. Assignment

You may not transfer or assign these Terms or any of your rights or obligations under them without our prior written consent, and any such attempt is void. We may transfer or assign these Terms and our rights and obligations without consent or notice to you.

23. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of Pakistan. Any dispute shall be subject to the exclusive jurisdiction of the courts of Multan, Punjab.

We reserve the right to update, change, or replace any part of these Terms by posting updates to our website, and it is your responsibility to check periodically for changes.
